From my friend, Shel HartLast week, a group of state attorneys general announced they reached a $26 billion settlement with Johnson & Johnson and three of the largest drug distributors in the U.S. It took a half million deaths and over 3,000 lawsuits to generate such a landmark settlement. Mckesson, Cardinal Health, and AmerisourceBergen must pony up $21B over 19 years while Johnson and Johnson pick up $5B over 9 years. The distributors, accused of lax controls allowing massive amounts of these addictive painkillers into illegal channels, and J&J for downplaying the risk posed in their massive marketing campaigns. Of course, this settlement has all parties denying wrongdoing. What’s a mere $26B when the 4 combined drug companies generated an astounding $656B in revenues? The settlement is a mere 4% of their combined annualized one-year revenues. From the accountant’s and shareholder vantage point, was the 4% or revenue risk was worth it for such a profitable run on the product? $26B / 500k lives is $52,000 a life. And that $52k per life isn’t going to the families of the deceased and instead to fight the ongoing battle within our states to support the rehabilitation efforts for those, and their families, deeply afflicted by this ongoing addiction. Some inquire why I’m a bit jaded by the claims made by big pharma. Here’s a handful of interesting facts:• 2019 J&J was the 25th most profitable company in the world (ranked by net income). It beat out Walmart! • The top big pharma companies spend as much as $.19 in marketing and advertising for every $1 of revenue. Marketing/Advertising spend often trumps the actual research and development (R&D) costs they incur.• In a 24-year period, Big Pharma companies paid 373 settlements for marketing fraud alone. The settlements totaled $35.7 billion.• In 2012, GlaxoSmithKline (GSK) agreed to a $3 billion settlement. It was the largest health care fraud settlement in U.S. history.• Johnson & Johnson paid $2.2 billion in 2013 for improperly marketing its drug Risperdal.• Check out more of the top lawsuit awards: https://www.pharmaceutical-technology.com/…/biggest…/• While immediate injuries from vaccinations may be rare, anyone harmed by the new COVID-19 vaccines won’t be able to sue one of the manufacturers who produced them. We also simply don’t know what long term implications that may result from the new experimental vaccines. To be clear, I’m a free-market and freedom loving American. I have absolutely zero problem with running a profitable company and spending whatever is deemed appropriate on marketing and advertising. I also do my best not to judge others for their decisions pertaining to lifestyle or prescription drug usage. I simply try my best to live through example. That said, when I step away from the headlines and distractions, I can’t help think how the combination of fear, ignorance, power, profit, and little risk to the manufacturing supply chain interplay, creating a deep skepticism within me. I believe in the best of people and don’t identify as an optimist or pessimist. I’m a self-professed “realist with a positive attitude”. Experience has also deepened my understanding that the best indicator of future performance is past performance. And the past performance of those currently influencing the current narrative have much to question… Continue to seek your own truth and look to the amazing restorative power within you. How you think, what you ingest, how you take in your environment, and how you move…. Your head, heart, hands, and habits play a big role in WHO and WHERE you are. YOU have an ability to change your trajectory and the answer doesn’t always have to be found in a pill. Think wisely.
